This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of concerned website. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

A breach or violation of any of the Terms will result in an immediate termination of your Services and/or appropriate action as deemed fit by Snack Right.

Snack Right reserves the right, at its sole discretion, to modify or replace any part of this Agreement. Any new features/ information which are added to the current website shall also be subject to the Terms of Service. Snack Right may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Snack Right maintains this Website as a service to the user community that visits the Website subject to these Terms and Conditions. You are responsible for obtaining any equipment and Internet service necessary to access our Website and for paying any fees for the equipment and service you select. We may alter, suspend, or discontinue this Website/ Services in whole or in part, at any time and for any reason, without notice. The Website may occasionally become unavailable due to maintenance or upgradation or for other reasons.

You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content.

Content provided on this site is solely for informational purposes applicable to normal healthy population. It is your sole responsibility to consult a licensed physician/dietician regarding the suitability of consumption of specific snack items made available through our service. Even though we stay true to whatever information claimed on the website/ individual snack packs, it will be your responsibility to consider your medical history/dietary history/preferences/allergies and other physical/physiological aspects prior to consuming our snacks. Snack Right cannot be held responsible for any medical/physical/physiological issues faced by you.

All descriptions of products or product pricing are subject to change without notice, at our sole discretion. We reserve the right to discontinue any product at any time or decide the duration of an offer period/ product.

Website & Service usage

Users have a personal, non-transferable, non-exclusive right to access and use the Content of this Website subject to these Terms and Conditions. The term “Content” means all information, text, images, data, links, software, or other material accessible through the Website or Services, whether created by us or provided by another person for display on the Website or through the Services.

The Content may contain typographical errors, other inadvertent errors or inaccuracies. We reserve the right to make changes to document names and content, descriptions or specifications of products or services, or other information without obligation to issue any notice of such changes.

You may view, copy, download, and print Content that is available on this website or through the Services, subject to the following conditions:

Subscription & Use of Customer Data

For your convenience as a Snack Right subscriber, all information that you provide to Snack Right is subject to Snack Rights’ Privacy Policy.

You are required to provide us with your name, DOB, contact, address, e-mail while placing your order through this Website. By using this Website, it is deemed that you have consented to receiving calls, autodialed and/or pre-recorded message calls, from us at any time with the use of the telephone that has been provided by you for the use of this website which are subject to the Privacy Policy. This includes contacting you through information received through other parties. Subscription by you is also your consent to receive SMSs, emails from us at any time we deem fit. This consent to be contacted is for purposes that include and are not limited to clarification calls and marketing and promotional calls. In case you wish to stop contact from us for the same, you may send us an email to customercare@snackright.in regarding the same. You may also be contacted by Service Providers with whom we have entered into a contract in furtherance of our rights, duties and obligations under this document and all other policies followed by us. Such contact will be made only in pursuance of such objectives, and no other calls will be made. The sharing of the information provided by you will be governed by the Privacy Policy and we will not give out such contact information of yours to third parties not connected with the Website/service.

If, conditionally you send certain specific information, entry forms, posters, articles, ideas, suggestions, comments, testimonials or other materials, whether online, by email, by postal mail, or otherwise, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these.

Fortnightly Delivery & Contents

As a subscribed Snack Right member, every fortnight  we will ship you a package with a selection of  snacks as per plan subscribed by you,  that may consist of a selection from granola bars, dry fruit nut bars, cereal or legume crisps, cereal pulse snack mixtures, cookies, crackers, bars, beverages  or other related snack items (“Products”). There are a variety of snacks/ products in each box[on an average 10 different varieties in each] whose selection will be at sole discretion of Snack Right team and would change in every box with newer varieties added [with a chance of 10-40% repeat products]. Snack Right cannot guarantee that a product available in a particular time frame will be available in any subsequent timeframe.

Once you register with us, we shall inform you the earliest possible date for delivery/ start of service, so as to ensure you get efficient and fit in our fortnightly cycle.

Billing & Payments

By subscribing you agree to pay Snack Right  the subscription fee for the products according to the plan chosen by you as indicated (additional payment terms may be included in other communications). Payments in full [as per chosen plan] can be done via NEFT directly to the account [details to be shared with you after registration process] or by Cash on delivery [COD]. We do not offer installment facility. For NEFT, parcel will be dispatched on receipt of payment. You can renew the service for duration of your choice by a new payment with fees as indicated at time of renewal.  Payments are not refundable; but in case of a situation [if acceptable to Snack Right] the service may be paused for a certain period of time; if intimated to us as per our conditions mentioned below. In case of COD payment to the courier staff should be done in cash. Cheque or DD is not acceptable. The invoice amount will be inclusive of all charges. Please note that prices are subject to change without prior notice; you will be charged amount as indicated during your registration through our confirmation mail.

Delivery/ Shipping

Unless otherwise indicated at the time of your purchase, shipping and handling fees are included with your order. Shipping dates and/or arrival times are only estimates. Exact time/ day for arrival of parcel cannot be communicated. If the delivery is not executed during first attempt due to incorrect or insufficient address, recipient not at home, address found locked or refusal to accept, the customer shall still be charged for the order. No refunds would be entertained for such items. But we will try co-ordinate with the customer / shipping partner to complete the delivery. Your delivery address should be under serviceable network of the couriers but we reserve the right to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

For loss/damage claims, you must notify Snack Right on the same day/date of receiving the purchase if you believe all or part of your order is missing or damaged and make sure you get an acknowledgement from us for the same. No complaints would be entertained after 24 hours of delivery of parcel to you.

Limitation of Liability

In no event shall snack right or its officers, directors, employees,  agents or affiliates be liable to any user of this website or any other person or entity for any direct, indirect, special, incidental, consequential or exemplary damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, loss of use, or costs of obtaining substitute goods or services) arising out of the use, inability to use, delay, unauthorized access to or use or misuse of the products  or service or the website or any information contained thereon, whether based upon warranty, contract, tort (including negligence), or otherwise, even if has been advised of the possibility of such damages or losses.

If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law. You agree snack right’s total cumulative liability in connection with these terms and conditions, the website, the content, or any product or services whether in contract, tort, or otherwise, shall not exceed the amount you paid to snack right in the then-prior calendar month. The existence of more than one claim will not enlarge this limit. You agree that our agents will have no liability of any kind arising from or relating to this agreement.

Disclaimer of Warranty

You are solely responsible for determining if the products are suitable for use or consumption. We take great effort to accurately label our products for your information. Under no circumstances will we be liable for any loss or damage caused by your use of the Products or your reliance on information in any Content on this Website. You agree that your sole and exclusive solution arising from or relating in any way to any product shall be its replacement or a credit towards another monthly shipment, in snack right’s discretion.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Mumbai, Maharashtra India.

Service use by Minors

Snack Right services are available only to, and may only be used by, individuals who are 18 years and older who can form legally binding contracts under applicable law. Individuals under the age of 18 can use this service only in conjunction with and under the supervision of a parent or legal guardian. In this case, the adult is the user and is responsible for any and all activities, subscribers and purchasers.

Links to Third-Party Websites

This Website may contain links to third party Websites that are provided to you as a convenience. Any outside Website accessed from our Website is independent from Snack Right, and we have no control over the content of such Websites. We are not responsible for the content/ Privacy Policy of any linked Website or for any loss or damage incurred in connection with your use such links or dealings with the operators of such third party Websites.

Intellectual Property & Copyright infringement

The Site and all of its original content are the sole property of  Snack Right and are, as such, fully protected by the appropriate international copyright and other intellectual property rights laws.If you believe that material located on or linked to by Snack Right violates your copyright, you are encouraged to notify Snack Right. Snack Right will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material.

Business Transfers

If Snack Right, or substantially all of its assets, were acquired, or in the unlikely event that Snack Right goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Snack Right may continue to use your personal information as set forth in this policy.
